BrookHill Puppy Agreement

The Purchaser and Breeder agree that the terms and conditions of the sale of the Puppy are as follows:

  1. Purchaser shall pay to breeder an adoption fee in an amount previously agreed to for the Puppy (the "Fee").
  2. Breeder shall complete the litter registration with the AKC and provide the document needed to transfer ownership records for the Puppy to Purchaser. Purchaser's ownership of the Puppy is limited to prohibit breeding and participating in AKC sanctioned Conformance Shows and Purchaser agrees to have the Puppy neutered once the Puppy has reached 8 months of age and prior to the time it reaches 12 months of age. If Purchaser breaches this provision, Breeder shall have the right to require Purchaser to return the Puppy to Breeder, along with the documentation necessary to transfer the AKC registration of ownership back to Breeder. No portion of the Fee will be refunded in such an event.
  3. Purchaser is responsible for the Puppy"s health once Purchaser has paid the Fee to Breeder and collected the Puppy (the "Transfer Date"). The Purchaser agrees to provide for safe, humane care, treatment and training for the Puppy. The Puppy shall be maintained in a safe and secure environment. Tying the Puppy on a rope while unattended and allowing the Puppy to roam at large are examples of default under this paragraph. If Purchaser breaches this provision, Breeder shall have the right to require Purchaser to return the Puppy to Breeder, along with the documentation necessary to transfer the AKC registration of ownership back to Breeder. No portion of the Fee will be refunded in such an event.
  4. If at any time Purchaser decides or determines that it no longer wants or can no longer keep or care for the Puppy, Purchaser shall return the Puppy to Breeder. Purchaser shall provide to Breeder with the documentation necessary to transfer the AKC ownership records of the Puppy to Breeder. No portion of the Fee will be refunded in such an event.
  5. If at anytime during the first 14 days after the Transfer Date Purchaser believes that, based on examination and the advice of a licensed Veterinarian (written evidence required), the Puppy may have pre-existing (prior to the Transfer Date) chronic health problems, Breeder agrees to allow Purchaser to return the Puppy in exchange for a refund of the Fee; or exchange the Puppy for a puppy from the next litter bred by Breeder. Purchaser shall choose a puppy of the same gender of the Puppy after Breeder has selected one male and one female from the litter as not being available to Purchaser.
  6. Provided the Purchaser has not improperly exercised the Puppy during the first 2 years (jogging, running behind bicycles, continued jumping from high places-such as a truck or SUV, etc.); or maintained the weight of Puppy above recommended levels, upon receipt by Breeder from Purchaser after the Puppy has reached 2 years of age but by the time Puppy is 30 months old of an Orthopedic Foundation For Animals ("OFA") report for the Puppy's hips that indicates a grade other than "Excellent", "Good", or "Fair", Breeder agrees as follows:
    1. To allow Purchaser to return the Puppy in exchange for a refund of the Fee;
    2. To exchange the Puppy for a puppy from the next litter bred by Breeder. Purchaser shall choose a puppy of the same gender as the Puppy after Breeder has selected one male and one female from the litter as not being available to Purchaser; or
    3. In the event that Purchaser elects to keep the Puppy and by the time the Puppy is 5 ½ years old, based on the recommendation of a licensed Veterinarian, Purchaser causes the hip dysplasia to be corrected by surgery, Breeder shall pay an amount equal to the Fee times 125% to the Veterinarian on behalf of Purchaser as a partial payment for said surgery. PROVIDED, however, that in no event shall Breeder"s obligation under this paragraph exceed the actual cost of the surgery it being understood by Purchaser that purpose of the payment would be ONLY to benefit the Puppy, not Purchaser.
  7. Purchaser shall advise Breeder if at any time Puppy displays continuing physical or health problems and agrees to provide any and all information pertaining to such problems.
  8. Purchaser agrees to assign to Breeder its right to name the Puppy for AKC registration purposes. The name will include the use of Breeder"s kennel name, BrookHill, as the first 9 letters in Puppy"s name and Purchaser agrees that Purchaser shall not attempt to change the Puppy's name.

    The sections of this Agreement not satisfied by a required action or expiration shall remain in effect throughout the life of the Puppy.

    The foregoing is hereby agreed to as of the date first written above and shall be in effect only when signed by both Purchaser and Breeder.

    Our goal is to place our puppies in homes as pets and restrict them against being bred or shown. Purchaser understands that the reason for this restriction is that Breeder believes it is its responsibility to prevent the breeding of any dog that is not healthy or that does not exemplify the breed standard.  However, occasionally, we agree to forego this restriction, provided that breeding and showing is secondary to giving the Puppy a loving home as a pet and companion.  In such event, the above puppy agreement would not apply and a different agreement would be used in its place.
